\nAs\nfar as possible, the Agreement should be used to promote\nresponsible fishing in Mauritian waters and the\nprinciple of non-discrimination between the different fleets\nfishing in those waters.
\n\nScientific cooperation: during the period covered\nby this Agreement, the Union and the Mauritian authorities shall\nendeavour to monitor the evolution of resources in Mauritius\nwaters. They undertake to consult one other to ensure the\nmanagement and conservation of living resources in the Indian Ocean\n, and to cooperate in the relevant scientific research.
\n\nFishing activities by Union vessels: the Agreement\nprovides that the Republic of Mauritius authorises Union vessels to\nfish in its waters in accordance with the provisions laid down in\nthe Fishing Protocol and its Annex. In return, this country will\nreceive a financial contribution from the EU.
\nUnion\nvessels may only exercise their fishing activities once they are in\npossession of a fishing authorisation, as defined in the\nAgreement.
\n\nOther measures: provision is also made for the\nfollowing:

\n-\nfishing opportunities: number of vessels\nauthorised to fish:
\n-\nfinancial contribution: the financial contribution\nis EUR 1 980 000 for the total duration of the\nProtocol.
\nThis amount includes:
\nThe\nannual financial contribution of EUR 660 000 is based on an annual\nreference tonnage. Where the annual quantity caught exceeds\n5 500 tonnes, the amount of the annual financial\ncontribution will be increased by EUR 65 for each additional tonne\ncaught. However, the total annual amount paid by the EU may not\nexceed EUR 715 000 per year.
\nThe\nfishing opportunities may be adapted by common agreement as long as\nthe recommendations of the Indian Ocean Tuna Commission (IOTC)\nconfirm that this adjustment will guarantee the sustainable\nmanagement of tuna and tuna-like species in the Indian Ocean. In\nthis case, the financial contribution shall be adjusted\nproportionately and pro rata temporis without however\nexceeding twice the annual financial contribution (i.e. EUR 357 000\nx 2).
\nNew\nfishing opportunities not covered by the Agreement could also be\nenvisaged following consultation and agreement between the\nParties.
\n\nDuration of the Agreement and the Protocol: the\nAgreement applies for 6 years from the date of its entry\ninto force. It is tacitly renewable for successive periods\nof three years, unless it is terminated.

\nPURPOSE: to present a Commission report on Council\nRegulation (EC) n° 2371/2002 regarding the chapters\nConservation and Sustainability and Adjustment of Fishing Capacity\nand also on the arrangements set out in Article 17 (2) on fishing\nrestrictions in the 12 nautical miles waters.
\nCONTENT: in accordance with Council Regulation (EC) No\n2371/2002 on the conservation and sustainable exploitation of\nfisheries resources under the Common Fisheries Policy (CFP), the\nCommission presents a report on the operation of the CFP with\nrespect to chapters II (Conservation and Sustainability) and III\n(Adjustment of Fishing Capacity) as well as on the arrangements on\nfishing restrictions in the 12 nautical miles waters. This report\ncomplements the reporting in the Green Paper on the Reform of the Common\nFisheries Policy.
\nConservation and sustainability: since 2002, multi-annual recovery and management\nplans with clear objectives and harvest rules have become the core\nof the conservation policy. They balance ecological requisites\n(state of the stocks and exploitation rates) and economic and\nsocial considerations (stability of catches).
\nImprovements in the situation since\n2003: a decrease in the numbers of\nstocks outside safe biological limits, as well as in stocks for\nwhich a fishing closure has been advised. However, of the stocks\nfor which robust data is available, over 60% is still fished beyond\nmaximum sustainable yield.
\nProgress has been made as regards the levels of Total\nAllowable Catches (TAC) adopted by Council, compared to sustainable\ncatch levels. There has also been an increase in the number of\nstocks for which no scientific advice is available.
\nThe Commission’s report confirms that:
\n\n· \nmulti-annual plans are more\neffective in taking a long-term\nperspective in managing stocks than the annual TAC decision-making,\nespecially since Council has started to respect the rules of the\nplans for the TACs;
\n\n· \nnevertheless, the framework resulting from the\n2002 CFP reform has not curbed overfishing enough, so EU\nfisheries continue to see declining catches taken from EU\nwaters;
\n\n· \nthe very significant gap between the levels of\nTACs agreed in Council and sustainable catches confirms the\nprevalence of short-term concerns over long-term\nsustainability. This continues to put stocks at further risk,\nthough the recent narrowing of the gap is a significant step\nforward;
\n\n· \nwhile vital to sound policy making, the\nknowledge base is under constant pressure, impeding progress\nin the coverage of stocks for which scientific advice is\nprovided;
\n\n· \nlastly, the new CFP needs to provide the right\ntools for integrating the ecosystems approach fully into\nconservation and sustainability.
\n2) Adjustment of fishing capacity: in 2002, responsibility for adjusting the size of\nthe fleet was devolved to Member States. From then on, targets for\nmandatory cuts to fishing capacity were no longer set.\nNevertheless, there were still global limits on fishing capacity\nper Member State, and these have been complied with.
\nHowever, it is clear that there is still\nsignificant over-capacity, and this is still a serious\nproblem. The devolution of fleet management to Member States has\nnot led to sufficient cuts in fleet capacity, even if nominal\ncapacity is within the ceilings set for Member States. Adjustment\nhas been relatively slow, despite the poor state of stocks\nthroughout the EU.
\nAll Member States have complied with legal fishing\ncapacity limitations. Though some had\ndifficulties when the new rules came into force, today most Member\nStates have fleets with capacity under the ceilings they are\nallowed.
\nLastly, Member States are obliged to report on fleet\ncapacity, and this is an essential component of the policy. The\nresults assessed are not satisfactory. The reporting tool has\nnot enabled precise estimates of excess fishing capacity per\nsegment or fishery.
\nIn view of these considerations, some conclusions can\nbe drawn concerning the performance of the fishing capacity\nmanagement provisions:
\n\n· \ndespite compliance with the fishing capacity\nmanagement rules defined at EU level, there are still clear\nindications of over-capacity in the EU fleet, namely: excess of\nfishing mortality in some stocks, low profitability and low\ncapacity utilization;
\n\n· \nwhile tonnage is a reliable fishing capacity\nindicator, the Commission has serious concerns about the\nreported power of fishing vessels, as the data suggest\nunder-declaration, making it extremely difficult to estimate fleet\ncapacity accurately;
\n\n· \nthe policy is static, in that it only\nestablishes a ceiling, with no specific objectives for\nreduction. Compliance with nominal capacity limits under these\nceilings does not mean that there is no persistent overcapacity.\nThe system does not integrate technical progress into the\nmanagement measures;
\n\n· \nit has proven very difficult to set clear\nobjectives for the size of the fleet and to monitor the balance\nbetween fishing capacity and fishing opportunities due to the\ncomplexity inherent in quantifying over-capacity. Determining an\nadequate level for the size of the fleet given a certain amount of\nfishing possibilities needs to take into account factors other than\nthe biological and economic.
\n3) Fishing restrictions in the 12 nautical miles\nwaters: the objectives related to\nintroduction (before entry into force of the CFP) of specific\narrangements in the waters up to 12 nautical miles were: (i)\nconservation of fish resources through allowing only small-scale\ncoastal fleets into the area; (ii) preservation of coastal fleets'\ntraditional fishing activities to maintain the social and economic\ninfrastructure of these areas.
\nThese specific restriction provisions were introduced\nin the CFP in 1983 and have been extended with every reform of the\npolicy since.
\nSince 2002, the Commission has not been not\ninformed of (real) problems or conflicts on specific\nrestrictions, whether on setting them, or on their management\nand functioning. Member States were able to resolve problems\nwithout having to refer any of them to the Commission. The\nregime is very stable, and the rules have continued to operate\nsatisfactorily. All Member States stressed the importance of the\nspecific restrictions in the light of their original objectives.\nOne Member State suggested extending the 6-12 miles regime to 10-20\nmiles to achieve the regime’s objectives more\neffectively.
\nConsidering the current conservation state of many\nstocks, and the continued sensitivity of coastal waters for\nconservation, as well as ongoing difficulties in coastal areas\nhighly dependent on fisheries and unlikely to benefit from other\neconomic development, the objectives for the specific regime\nappear to remain as valid as they were in 2002. Modifying\ncurrent arrangements might disrupt the current balance that has\ndeveloped since the introduction of the special regime.
\nThe Committee on Fisheries adopted the initiative\nreport by Carl HAGLUND (ALDE, FI) on reporting obligations under\nRegulation (EC) No 2371/2002 on the conservation and sustainable\nexploitation of fisheries resources under the Common Fisheries\nPolicy (CFP).
\nMembers note that the\nCommission has now fulfilled its commitments under Council\nRegulation No 2371/2002, which obliges it to report on i) the\noperation of the CFP with respect to Chapters II (Conservation and\nSustainability) and III (Adjustment of Fishing Capacity) of that\nregulation; and ii) on the arrangement on fishing restrictions in\nthe 12 nautical mile zone.
\nConservation and sustainability (Chapter\nII): the report stresses the need for a balance between the\necological and the economic and social situation in each\nfishery while acknowledging that without plentiful fish stocks\nthere will be no profitable fishing industry.
\nMembers believe that, as\npart of the objective of guaranteeing sustainability, the policies\nconsidered should focus on the future of the fishing sector and,\nconsequently, on facilitating the entry of new generations of\nfishermen. They call on the Commission, the Member States and\nthe Regional Advisory Councils (RACs), in the future, to use the\necosystem approach as a basis for all long-term management\nplans (LTMPs) which should be the basis of the future\nCFP.
\nThe report highlights the\nneed to develop an effective no-discards policy at EU level\nwhereby the Community Fisheries Control Agency (CFCA) has greater\npowers to ensure a fair system of rules and sanctions. It also\nstresses that selective fishing gear and other devices which\nreduce or eliminate by-catches of non-targeted species, or of\njuveniles of targeted species, should be promoted, along with other\nsustainable fishing methods.
\nThe Commission is invited to:
\n\n· \nprovide for the establishment of long-term\nmanagement plans for all commercial EU fisheries within a\nhighly decentralised management regime which fully involves all\nrelevant stakeholders;
\n\n· \nassess the possibility of establishing a\nnetwork of closed areas in which all fishing activities are\nprohibited for a certain period of time in order to increase fish\nproductivity and conserve living aquatic resources and the marine\necosystem;
\n\n· \naddress immediately the lack of sufficient\nreliable data necessary for sound scientific advice by\nestablishing a system whereby Member States which do not fulfil\ntheir respective obligations regarding data collection and\ntransmission under the European fisheries data programme are\nsanctioned.
\nThe report emphasises that\nscientific fisheries research is an essential tool for\nidentifying factors that influence the development of fishery\nresources, with a view to carrying out a quantitative assessment\nbut also for improving fishing gear. In this context, it stresses\nthe need to invest in the training of human resources, to provide\nadequate financial resources and to promote cooperation between\nvarious public bodies in the Member States.
\nAdjustment of fishine capacity (Chapter\nIII): the report calls on the\nCommission to:
\n\n· \nestablish a definition of overcapacity at\nEU level, accommodating regional definitions and taking into\naccount local specificities;
\n\n· \nredefine fishing capacity in such a way\nthat both the vessel’s\nfishing capacity and its actual fishing effort are taken as a\nbasis;
\n\n· \nmeasure, before the end of 2013, the capacity\nof European fleets in order to establish where there is\novercapacity in relation to the resources available and what\nreductions/conversions are required;
\n\n· \nmonitor and adjust fleet capacity\nceilings for Member States so that\nthey are in line with reliable data and technical advances are\ntaken into account.
\nMembers emphasise that the\nfuture European Maritime and Fisheries\nFund (EMFF) must provide for adequate financial\nassistance to mitigate any socio-economic impact of measures\naimed at reducing overcapacity, and to adjust the size and effort\nof fishing fleets in line with fishing opportunities and long-term\nsustainability.
\nThe report stresses the need to set clear deadlines\nand make progress as soon as possible towards fleet adjustments\nwhere necessary. It urges the Commission to provide for a scheme\nof measures to sanction Member States which do not fulfil their\nrespective obligations within the set timelines, while also\nproviding adequate funding for this process, and to develop further\nthe concept of ecological and social conditionality in the\ncontext of access to fishing resources and remuneration which\nrewards sustainable fishing.
\nLastly, Members believe that, for the present, the\nspecial access regime for small-scale fisheries in the 12\nnautical mile zone should be retained, as should specific\nrestrictions for vessels registered in the ports of the Azores,\nMadeira and the Canary Islands in respect of the waters around\nthese archipelagos, particularly the bio-geographically sensitive\nareas currently covered by Council Regulation (EC) No\n1954/2003.
\nPURPOSE: to present a Commission report on Council\nRegulation (EC) n° 2371/2002 regarding the chapters\nConservation and Sustainability and Adjustment of Fishing Capacity\nand also on the arrangements set out in Article 17 (2) on fishing\nrestrictions in the 12 nautical miles waters.
\nCONTENT: in accordance with Council Regulation (EC) No\n2371/2002 on the conservation and sustainable exploitation of\nfisheries resources under the Common Fisheries Policy (CFP), the\nCommission presents a report on the operation of the CFP with\nrespect to chapters II (Conservation and Sustainability) and III\n(Adjustment of Fishing Capacity) as well as on the arrangements on\nfishing restrictions in the 12 nautical miles waters. This report\ncomplements the reporting in the Green Paper on the Reform of the Common\nFisheries Policy.
\nConservation and sustainability: since 2002, multi-annual recovery and management\nplans with clear objectives and harvest rules have become the core\nof the conservation policy. They balance ecological requisites\n(state of the stocks and exploitation rates) and economic and\nsocial considerations (stability of catches).
\nImprovements in the situation since\n2003: a decrease in the numbers of\nstocks outside safe biological limits, as well as in stocks for\nwhich a fishing closure has been advised. However, of the stocks\nfor which robust data is available, over 60% is still fished beyond\nmaximum sustainable yield.
\nProgress has been made as regards the levels of Total\nAllowable Catches (TAC) adopted by Council, compared to sustainable\ncatch levels. There has also been an increase in the number of\nstocks for which no scientific advice is available.
\nThe Commission’s report confirms that:
\n\n· \nmulti-annual plans are more\neffective in taking a long-term\nperspective in managing stocks than the annual TAC decision-making,\nespecially since Council has started to respect the rules of the\nplans for the TACs;
\n\n· \nnevertheless, the framework resulting from the\n2002 CFP reform has not curbed overfishing enough, so EU\nfisheries continue to see declining catches taken from EU\nwaters;
\n\n· \nthe very significant gap between the levels of\nTACs agreed in Council and sustainable catches confirms the\nprevalence of short-term concerns over long-term\nsustainability. This continues to put stocks at further risk,\nthough the recent narrowing of the gap is a significant step\nforward;
\n\n· \nwhile vital to sound policy making, the\nknowledge base is under constant pressure, impeding progress\nin the coverage of stocks for which scientific advice is\nprovided;
\n\n· \nlastly, the new CFP needs to provide the right\ntools for integrating the ecosystems approach fully into\nconservation and sustainability.
\n2) Adjustment of fishing capacity: in 2002, responsibility for adjusting the size of\nthe fleet was devolved to Member States. From then on, targets for\nmandatory cuts to fishing capacity were no longer set.\nNevertheless, there were still global limits on fishing capacity\nper Member State, and these have been complied with.
\nHowever, it is clear that there is still\nsignificant over-capacity, and this is still a serious\nproblem. The devolution of fleet management to Member States has\nnot led to sufficient cuts in fleet capacity, even if nominal\ncapacity is within the ceilings set for Member States. Adjustment\nhas been relatively slow, despite the poor state of stocks\nthroughout the EU.
\nAll Member States have complied with legal fishing\ncapacity limitations. Though some had\ndifficulties when the new rules came into force, today most Member\nStates have fleets with capacity under the ceilings they are\nallowed.
\nLastly, Member States are obliged to report on fleet\ncapacity, and this is an essential component of the policy. The\nresults assessed are not satisfactory. The reporting tool has\nnot enabled precise estimates of excess fishing capacity per\nsegment or fishery.
\nIn view of these considerations, some conclusions can\nbe drawn concerning the performance of the fishing capacity\nmanagement provisions:
\n\n· \ndespite compliance with the fishing capacity\nmanagement rules defined at EU level, there are still clear\nindications of over-capacity in the EU fleet, namely: excess of\nfishing mortality in some stocks, low profitability and low\ncapacity utilization;
\n\n· \nwhile tonnage is a reliable fishing capacity\nindicator, the Commission has serious concerns about the\nreported power of fishing vessels, as the data suggest\nunder-declaration, making it extremely difficult to estimate fleet\ncapacity accurately;
\n\n· \nthe policy is static, in that it only\nestablishes a ceiling, with no specific objectives for\nreduction. Compliance with nominal capacity limits under these\nceilings does not mean that there is no persistent overcapacity.\nThe system does not integrate technical progress into the\nmanagement measures;
\n\n· \nit has proven very difficult to set clear\nobjectives for the size of the fleet and to monitor the balance\nbetween fishing capacity and fishing opportunities due to the\ncomplexity inherent in quantifying over-capacity. Determining an\nadequate level for the size of the fleet given a certain amount of\nfishing possibilities needs to take into account factors other than\nthe biological and economic.
\n3) Fishing restrictions in the 12 nautical miles\nwaters: the objectives related to\nintroduction (before entry into force of the CFP) of specific\narrangements in the waters up to 12 nautical miles were: (i)\nconservation of fish resources through allowing only small-scale\ncoastal fleets into the area; (ii) preservation of coastal fleets'\ntraditional fishing activities to maintain the social and economic\ninfrastructure of these areas.
\nThese specific restriction provisions were introduced\nin the CFP in 1983 and have been extended with every reform of the\npolicy since.
\nSince 2002, the Commission has not been not\ninformed of (real) problems or conflicts on specific\nrestrictions, whether on setting them, or on their management\nand functioning. Member States were able to resolve problems\nwithout having to refer any of them to the Commission. The\nregime is very stable, and the rules have continued to operate\nsatisfactorily. All Member States stressed the importance of the\nspecific restrictions in the light of their original objectives.\nOne Member State suggested extending the 6-12 miles regime to 10-20\nmiles to achieve the regime’s objectives more\neffectively.
\nConsidering the current conservation state of many\nstocks, and the continued sensitivity of coastal waters for\nconservation, as well as ongoing difficulties in coastal areas\nhighly dependent on fisheries and unlikely to benefit from other\neconomic development, the objectives for the specific regime\nappear to remain as valid as they were in 2002. Modifying\ncurrent arrangements might disrupt the current balance that has\ndeveloped since the introduction of the special regime.
\nIn accordance with Council\nRegulation (EC) No 2371/2002 on the conservation and sustainable\nexploitation of fisheries resources under the Common Fisheries\nPolicy (CFP), the Commission presents a report on the operation of\nthe CFP with respect to chapters II and III.
\nThe Commission is also\nobliged to report on the arrangements set out in Article 17\nparagraph 2 on fishing restrictions in the 12 nautical miles waters\nby 31 December 2011. This report complements the reporting in the\nGreen Paper on the Reform of\nthe Common Fisheries Policy.
