Amendment 18 # Carlos José ITURGAIZ ANGULO Proposal for a regulation Recital 2 (2) The anchovy fishery in Bay of Biscay has been closed since 2005 due to the poor state of that stock, a situation to which climate change has made a significant contribution. Amendment 19 # Carlos José ITURGAIZ ANGULO Proposal for a regulation Recital 3 a (new) (3a) In order to make the plan more effective, account should be taken of the repercussions of global warming, which is causing this species to move northwards. This will entail extending the scope of the plan to ICES Zone VII. Amendment 20 # Carlos José ITURGAIZ ANGULO Proposal for a regulation Recital 5 (5) It stems from the advice provided by the STECF that harvesting a constant proportion of the spawning stock biomass would provide for sustainable stock management. The STECF also advises that the minimum spawning biomass level at which the stock could start to be harvested should be set at 24 000 tones and the precautionary biomass levels at 33 000 tones. Furthermore, the appropriate harvest rate should be 340% of the spawning stock biomass each year, subject to appropriate restrictions. This rate would minimize the risk of the stock falling below the minimum spawning biomass level, as well as the probability of a fishery closure, while keeping high yields. Amendment 21 # Carlos José ITURGAIZ ANGULO Proposal for a regulation Recital 7 a (new) (7a) In addition to the scientific campaigns carried out in the spring to assess biomass, account should be taken of the estimates obtained in the autumn. If the fishery is closed, this might make it possible to resume fishing with a TAC set at a precautionary level for the second half of the fishing season. Amendment 23 # Carlos José ITURGAIZ ANGULO Proposal for a regulation Article 2 This Regulation shall apply to the stock of anchovy which inhabits ICES Zones VII and VIII. Amendment 27 # Carlos José ITURGAIZ ANGULO Proposal for a regulation Article 5 – paragraph 1 a (new) 1a. Once a 'zero' TAC has been set, if estimates from the autumn scientific campaign relating to the level of recruitment predict at least a precautionary level of biomass, and with a view to the spring scientific campaign, a TAC shall be agreed for the first half of the following year at the most appropriate level entailing the least possible risk to the state of the fishery. Amendment 31 # Carlos José ITURGAIZ ANGULO Proposal for a regulation Article 5 - paragraph 2 - point a (a) where STECF advises that the catches of anchovy should be reduced to the lowest possible level, the TAC and quotas shall correspond to a reduction of 25a maximum of 10 % compared to the TAC and quotas applicable for the previous fishing season, while guaranteeing that the TAC is never lower than 7 000 tonnes; Amendment 32 # Carlos José ITURGAIZ ANGULO Proposal for a regulation Article 5 - paragraph 3 3. Each year, the Commission shall inform the Member States concerned of the STECF advice and shall confirm the TAC and quotas corresponding thereto in accordance with Annex I and applicable for the fishing season starting as of 1 July of that year and publish it in the C-edition of the Official Journal of the European Union and on the Commission’s website. Where necessary, the Commission shall announce an indicative TAC by 1 July, pending the setting of a definitive TAC within 15 days following the start of the season. Amendment 33 # Carlos José ITURGAIZ ANGULO Proposal for a regulation Article 13 The transhipment of anchovy at sea shall be ~~prohibit~~authorised in the areas referred to in Article 2. The competent authorities shall ensure the appropriate monitoring of catches transhipped.
