            "<div id=\"summary\">\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">PURPOSE: to amend Directive 2006/66/EC by limiting the\nexemption for the use of cadmium in portable batteries and\naccumulators intended for use in cordless power tools to 1 January\n2016.</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">PROPOSED ACT: Directive of the European Parliament and\nof the Council.</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">BACKGROUND: Directive 2006/66/EC of the European\nParliament and of the Council</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">on batteries and accumulators and waste batteries and\naccumulators and repealing Directive 91/157/EEC prohibits the\nplacing on&#160; the market of portable batteries and accumulators,\nincluding those incorporated into appliances, that contain more\nthan 0.002% of cadmium by weight therein. However, <b>the portable\nbatteries and accumulators intended for use in cordless power tools\nhave been exempt from that ban.</b></span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">The Commission has reviewed that exemption with a view\nto the prohibition of cadmium in batteries and accumulators. That\nreview led to the conclusion that, in order to gradually diminish\nthe amount of cadmium released to the environment, the prohibition\nof the use of cadmium should be extended to portable batteries and\naccumulators intended for use in cordless power tools as suitable\ncadmium-free substitutes for these applications are available on\nthe market, namely nickel-metal hydride and lithium-ion battery\ntechnologies</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">IMPACT ASSESSMENT: the Commission's impact assessment\nconcludes that compared to the baseline scenario the other policy\noptions related to a withdrawal of the exemption (immediate\nwithdrawal or withdrawal in 2016) would lead to a lower overall\nenvironmental impact, both in terms of avoiding releases of cadmium\nto the environment and in terms of aggregated environmental impacts\nbased on six environmental indicators.</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">The impact assessment concludes that if the exemption\nis withdrawn in 2016, the environmental benefits would be slightly\nlower than in the case of immediate withdrawal but the <b>costs\nwould be much lower</b> compared to an immediate withdrawal. Over\nthe period 2013-2025, a cordless power tools with alternative\nbattery chemistry will, depending on the alternative battery\nchemistry chosen (nickel metal hydride or lithium-ion), cost EUR\n0.8 and EUR 2.1 more respectively if the exemption is immediately\nwithdrawn and an additional EUR 0.4 and EUR 0.9 respectively in the\ncase of withdrawal in 2016.</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">As <b>withdrawal of the exemption in 2016</b> would\nhave almost the same level of effectiveness at a higher efficiency\ncompared to an immediate withdrawal, this option is the preferred\none.</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">LEGAL BASIS: Article 192 (1) of the Treaty on the\nFunctioning of the European Union.</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">CONTENT: the proposal amends Directive 2006/66/EC by\n<b>limiting the exemption for the use of cadmium in portable\nbatteries and accumulators intended for use in cordless power tools\nto 1 January 2016.</b> This means that as from this date, the use\nof cadmium in portable batteries and accumulators intended for use\nin cordless power tools, included those incorporated into\nappliances, is restricted to 0.002% of cadmium by weight in line\nwith Directive 2006/66/EC.&#160;</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">The proposal identifies the delegated and implementing\npowers of the Commission in Directive 2006/66/EC and establishes\nthe corresponding procedures for adoption of these acts <b>in\naccordance with Articles 290 (delegated acts) and 291 (implementing\nacts)</b> of the Treaty on the Functioning of the European\nUnion.</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">BUDGETARY IMPLICATIONS: the proposal has no\nimplications for the EU budget.</span></p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\">|DELEGATED ACTS: the proposal contains provisions\nempowering the Commission to adopt delegated acts in accordance\nwith Article 290 of the Treaty on the Functioning of the European\nUnion.</span></p>\n</div>\n"
