PURPOSE: to amend Directive 2006/126/EC ("Driving Licences Directive") in order to merge the driving licence with the drivers card. PROPOSED ACT: Directive of the European Parliament and of the Council. BACKGROUND: this proposal to modify Directive 2006/126/EC follows the proposal on amending Council Regulation (EEC) No 3821/85 on recording equipment in road transport ("the Tachograph Regulation") and amending Regulation (EC) No 561/2006. The two proposals constitute a legislative package aimed at better enforcing the social rules in road transport and at reducing frauds and administrative burden, by developing the technical aspects and increasing the efficiency of tachographs. Experience has shown that fraud and misuse of driving licences occurs less frequently than with the driver cards used in the recording equipment installed in vehicles used for the carriage of passengers or goods by road in accordance with the Tachograph Regulation. This recording equipment would therefore be more reliable if driver cards and driving licences were merged. Further, such a merger would reduce the administrative burden for drivers who would no longer need to apply for and hold two different documents. Driving licences and driver cards share an almost identical design and set of data fields. The only notable difference is that the driver cards must contain a microchip, whereas for driving licences the inclusion of such a microchip is optional. It follows that the merger of the two documents is easily achievable from a technical point of view. IMPACT ASSESSMENT: the stakeholder's consultation and impact assessment carried out in order to amend the Tachograph Regulation showed that merging the driver card with the driving licence is a solution for reducing fraud potential while at the same time limiting the costs (issuing and purchasing of one instead of two documents). Driving licences and driver cards are issued in credit card format and contain very similar information (drivers details, photograph, etc). The Driving Licence Directive already provides for the possibility of inserting a microchip in the standardised driving licence format. Moreover, both cards have a limited validity period of five years, since the Driving Licence Directive stipulates that, as from 19 January 2013, the driving licences of trucks and bus drivers will be valid for five years. Merging cards would therefore not require any change in the period of validity of the current tachograph cards and therefore of their durability. Merging driver cards with driving licences would facilitate detection at the roadside check of drivers using a card that does not belong to them or using two cards. Furthermore, the drivers will be less inclined to let other drivers use their driving licence to defraud the tachograph system. The impact assessment concluded that merging driver cards with driving licences would allow for a reduction of the administrative burden of around EUR 100 million per year. OBJECTIF : modifier la directive 2006/126/CE relative au permis de conduire de façon à intégrer les fonctionnalités d'une carte de conducteur. ACTE PROPOSÉ : Directive du Parlement européen et du Conseil. CONTEXTE : la présente proposition concernant la modification de la directive 2006/126/CE relative au permis de conduire fait suite à la proposition de règlement du Parlement européen et du Conseil modifiant le règlement (CEE) n° 3821/85 du Conseil concernant l'appareil de contrôle dans le domaine des transports par route (le règlement sur le tachygraphe) et modifiant le règlement (CE) n° 561/2006 du Parlement européen et du Conseil, adopté par la Commission le 19 juillet 2011. Les deux propositions constituent un paquet législatif visant à améliorer l'application des règles en matière sociale dans le transport routier et à réduire les fraudes et la charge administrative en développant les aspects techniques et en améliorant l'efficacité des tachygraphes. L'expérience a montré que l'utilisation frauduleuse du permis de conduire est moins fréquente que celle de la carte de conducteur utilisée dans l'appareil de contrôle à bord des véhicules de transport de passagers ou de marchandises par route. L'appareil de contrôle serait donc plus fiable si la carte de conducteur et le permis de conduire étaient fusionnés. La fusion de ces deux documents allégerait en outre la charge administrative pour les conducteurs, qui n'auraient plus besoin de demander ni de détenir deux documents différents. Le permis de conduire et la carte de conducteur sont, par leur conception et les données qu'ils contiennent, presque identiques. La seule différence notable tient à la présence obligatoire d'un microprocesseur sur la carte de conducteur, alors qu'elle est facultative sur le permis de conduire. Par conséquent, la fusion des deux documents est facile à réaliser d'un point de vue technique. ANALYSE DIMPACT : lanalyse dimpact a montré que la fusion de la carte de conducteur et du permis de conduire apparaissait comme une solution pour réduire les possibilités de fraude tout en limitant, à terme, les coûts (délivrance et achat d'un seul document au lieu de deux). Les permis de conduire et les cartes de conducteur sont délivrés au format carte de crédit et contiennent des informations très similaires (identité du conducteur, photographie, etc.). La directive sur le permis de conduire donne déjà la possibilité d'insérer un microprocesseur dans le format normalisé du permis de conduire. En outre, les deux cartes ont une durée de validité de cinq ans. La fusion des cartes de conducteur et des permis de conduire faciliterait la détection, lors des contrôles routiers, des conducteurs qui utilisent une carte qui n'est pas la leur, ou qui utilisent deux cartes. En outre, les conducteurs seraient moins enclins à laisser d'autres conducteurs utiliser leur permis de conduire pour des fraudes concernant le tachygraphe. L'analyse d'impact a conclu que la fusion des cartes de conducteur et des permis de conduire permettrait de réduire la charge administrative d'une centaine de millions d'euros par an. BASE JURIDIQUE : article 91 du TFUE. CONTENU : la proposition de modification du règlement n° 3821/85 (CEE) prévoit que les cartes de conducteur sont délivrées conformément aux dispositions du règlement sur le tachygraphe jusqu'au 18 janvier 2018. Elle prévoit également qu'à compter du 19 janvier 2018, la carte de conducteur est intégrée au permis de conduire et sa délivrance, son renouvellement, son échange et son remplacement sont conformes aux dispositions de la directive 2006/126/CE. Ce processus graduel de remplacement des cartes de conducteur par des permis de conduire nécessite une modification de la directive sur le permis de conduire, afin d'organiser au plan juridique la coexistence des deux fonctions sur un seul et même document, à savoir le permis de conduire, sur lequel sont intégrées les fonctionnalités de la carte de conducteur. Il est proposé quà partir du 19 janvier 2018, tout nouveau permis de conduire ou carte de conducteur soit délivré sous forme d'un seul document. En outre, à partir du 19 janvier 2018, la réception des permis de conduire délivrés aux conducteurs professionnels et intégrant donc les fonctionnalités d'une carte de conducteur pour tachygraphe devra respecter les exigences applicables au microprocesseur, fixées conformément à la présente directive, ainsi que toutes les exigences supplémentaires visées dans le règlement (CEE) n° 3821/85 du Conseil, telle que l'essai d'interopérabilité ou l'essai de fonctionnement. Il convient cependant, lors de l'exécution de mesures concernant la réception, d'éviter les redondances d'essai. La proposition n'aura pas de conséquence sur les permis de conduire des particuliers et ne concerne que les conducteurs professionnels soumis aux règles sur les durées de conduite et les temps de repos et qui doivent utiliser le tachygraphe. INCIDENCE BUDGÉTAIRE : la proposition n'entraîne pas de coût additionnel pour le budget de l'UE. New
