            "<div id=\"summary\">\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">PURPOSE: to conclude and Agreement on the promotion,\nprovision and use of GALILEO and GPS satellite-based navigation\nsystems and related applications between the United States of\nAmerica (US) and the European Community (EC) and its Member\nStates.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">PROPOSED ACT: Council Decision.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">BACKGROUND: on the basis of a Commission proposal of\n14 July 1999, the Council authorised the Commission on 30 September\n1999 to open negotiation with the US for the conclusion of an\nagreement concerning the development of a Civil Global Navigation\nSystem. These negotiations were successfully completed.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The Agreement was signed in Dromoland Castle, Ireland,\non 26 June 2004 and <b>entered into application provisionally on 1\nNovember 2008</b>. Member States have completed their respective\ninternal procedures related to the entry into force of the\nagreement.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">IMPACT ASSESSMENT: no impact assessment was\nundertaken.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">LEGAL BASIS: Articles 171(3) 172 in conjunction with\nArticle 218 (6) (a) of the Treaty on the Functioning of the\nEU.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">CONTENT: this proposal involves the conclusion of the\ne Agreement on the promotion, provision and use of GALILEO and GPS\nsatellite-based navigation systems and related applications between\nthe United States of America, of the one part, and the European\nCommunity and its Member States, of the other part. Bulgaria and\nRomania are to become parties to the agreement by the conclusion of\na protocol in accordance with Art 6(2) of the Act concerning the\nconditions of accession of the Republic of Bulgaria and Romania and\nthe adjustments to the treaties on which the European Union is\nfounded.&#160;</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><b><span lang=\"EN-GB\">Objectives:</span></b> <span lang=\"EN-GB\">the\nobjective is to provide a framework for cooperation between the\nParties in the promotion, provision and use of civil GPS and\nGALILEO navigation and timing signals and services, value-added\nservices, augmentations, and global navigation and timing goods.\nThe Parties intend to work together, both bilaterally and in\nmultilateral fora, as provided in the text, to promote and\nfacilitate the use of these signals, services, and equipment for\npeaceful civil, commercial, and scientific uses, consistent with\nand in furtherance of mutual security interests. The Agreement is\nintended to complement and facilitate agreements in force, or which\nmay be negotiated in the future, between the Parties related to the\ndesign and implementation of civil satellite-based navigation and\ntiming signals and services, augmentations, or value-added\nservices.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">Nothing in the Agreement shall supersede, modify or\nderogate from standards, procedures, rules, regulations and\nrecommended practices adopted in ICAO, or IMO, or under the\nMarrakech Agreement Establishing the World Trade\nOrganisation.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><b><span lang=\"EN-GB\">Interoperability and Radio Frequency\nCompatibility</span></b><span lang=\"EN-GB\">: the Parties agree that\nGPS and GALILEO shall be radio frequency compatible and, to the\ngreatest extent possible, interoperable at the non-military user\nlevel. In order to achieve this interoperability and facilitate the\njoint use of the two systems, the Parties agree to realise their\ngeodetic coordinate reference frames as closely as possible to the\nInternational Terrestrial Reference System. The Parties also agree\nto transmit the time offsets between GALILEO and GPS system times\nin the navigation messages of their respective services.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The radio frequency compatibility and interoperability\nworking group shall continue work already underway with a view\ntoward achieving, inter alia:</span></p>\n<ul style=\"margin-top:0cm\" type=\"disc\">\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">radio frequency compatibility in the modernisation or\nevolution of either system; (The Parties need to assess further the\nradiofrequency compatibility of GALILEO and GPS III).</span></li>\n</ul>\n<ul style=\"margin-top:0cm\" type=\"disc\">\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">enhanced signal availability and reliability through\ncomplementary system architectures for the benefit of users\nworldwide;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">interoperability at the non-military user\nlevel.</span></li>\n</ul>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The Council is requested to adopt the following\nproposal for a Decision on the conclusion of the agreement on\nbehalf of the European Union after the approval of the European\nParliament.</span></p>\n<p class=\"MsoNormal\"><span lang=\"EN-GB\">BUDGETARY IMPLICATION: the\nproposal has no implications for the EU budget.</span></p>\n</div>\n"

The Agreement is\nintended to complement and facilitate agreements in force, or which\nmay be negotiated in the future, between the Parties related to the\ndesign and implementation of civil satellite-based navigation and\ntiming signals and services, augmentations, or value-added\nservices.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">Nothing in the Agreement shall supersede, modify or\nderogate from standards, procedures, rules, regulations and\nrecommended practices adopted in ICAO, or IMO, or under the\nMarrakech Agreement Establishing the World Trade\nOrganisation.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><b><span lang=\"EN-GB\">Interoperability and Radio Frequency\nCompatibility</span></b><span lang=\"EN-GB\">: the Parties agree that\nGPS and GALILEO shall be radio frequency compatible and, to the\ngreatest extent possible, interoperable at the non-military user\nlevel. In order to achieve this interoperability and facilitate the\njoint use of the two systems, the Parties agree to realise their\ngeodetic coordinate reference frames as closely as possible to the\nInternational Terrestrial Reference System. The Parties also agree\nto transmit the time offsets between GALILEO and GPS system times\nin the navigation messages of their respective services.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The radio frequency compatibility and interoperability\nworking group shall continue work already underway with a view\ntoward achieving, inter alia:</span></p>\n<ul style=\"margin-top:0cm\" type=\"disc\">\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">radio frequency compatibility in the modernisation or\nevolution of either system; (The Parties need to assess further the\nradiofrequency compatibility of GALILEO and GPS III).</span></li>\n</ul>\n<ul style=\"margin-top:0cm\" type=\"disc\">\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">enhanced signal availability and reliability through\ncomplementary system architectures for the benefit of users\nworldwide;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">interoperability at the non-military user\nlevel.</span></li>\n</ul>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The Council is requested to adopt the following\nproposal for a Decision on the conclusion of the agreement on\nbehalf of the European Union after the approval of the European\nParliament.</span></p>\n<p class=\"MsoNormal\"><span lang=\"EN-GB\">BUDGETARY IMPLICATION: the\nproposal has no implications for the EU budget.</span></p>\n</div>\n"
