            "<div id=\"summary\">\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The Committee on Civil Liberties, Justice and Home\nAffairs adopted the own-initiative report by Cornelis de JONG\n(GUE/NGL, NL) on an EU approach on criminal law.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The report</span> <span lang=\"EN-GB\">welcomes the\nrecognition by the Commission in its recent <a href=\"http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=COM:2011:0573:FIN:EN:PDF\">Communication\non an EU criminal law policy</a> that the first step in criminal\nlaw legislation should always be to decide <b>whether to adopt\nsubstantive criminal law measures at all</b>.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">In this spirit, Members stress that proposals for EU\nsubstantive criminal law provisions must fully <b>respect the\nprinciples of subsidiarity and proportionality</b>. In their\nview,</span> <span lang=\"EN-GB\">the necessity of new substantive\ncriminal law provisions must be demonstrated by the necessary\nfactual evidence making it clear that:</span></p>\n<ul style=\"margin-top:0cm\" type=\"disc\">\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">the criminal provisions focus on conduct causing\nsignificant pecuniary or non-pecuniary damage to society,\nindividuals or a group of individuals;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">there are no other, less intrusive measures available\nfor addressing such conduct;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">the crime involved is of a particularly serious nature\nwith a cross-border dimension or has a direct negative impact on\nthe effective implementation of a Union policy in an area which has\nbeen subject to harmonisation measures;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">there is a need to combat the criminal offence\nconcerned on a common basis; and</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">the severity of the proposed sanctions is not\ndisproportionate to the criminal offence.</span></li>\n</ul>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The report stresses that harmonisation measures should\nbe proposed primarily with a view to <b>supporting the application\nof the principle of mutual recognition</b> in practice, rather than\nmerely expanding the scope of harmonised EU criminal law.</span>\nMembers also insist on the need to establish <b>uniform minimum\nstandards of protection at the highest possible level for suspects\nand defendants</b> in criminal proceedings in order to strengthen\nmutual trust. In this regard, they recall that criminal law must\n<b>fully respect the fundamental rights</b> of suspected, accused\nor convicted persons.</p>\n<p style=\"text-align:justify\" class=\"MsoNormal\">The Commission is\nencouraged to:</p>\n<ul style=\"margin-top:0cm\" type=\"disc\">\n<li style=\"text-align:justify\" class=\"MsoNormal\">put forward\nmeasures that <b>facilitate more consistent and coherent\nenforcement</b> at national level of existing provisions of\nsubstantive EU criminal law, without prejudice to the principles of\nnecessity and subsidiarity;</li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">include in its impact assessments the <b>necessity and\nproportionality test</b>;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\">draw on the\n<b>best practices</b> of those Member States with a high level of\nprocedural rights guarantees;</li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">include an evaluation based on its <b>fundamental\nrights checklist</b>; and</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\">introduce a test\nspecifying how its proposals reflect the <b>general principles</b>\ngoverning criminal law (e.g. principles of individual guilt; legal\ncertainty, non-retroactivity and the presumption of\ninnocence).</li>\n</ul>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The report underlines the need for a <b>more coherent\nand high-quality EU approach</b> to criminal law and deplores the\nfragmented approach followed so far.</span> With this in mind, it\ncalls for a clear, <b>coordinating authority</b> within the\nCommission for all proposals which contain criminal law\nprovisions.</p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">Members call for an <b>inter-institutional\nagreement</b> on the principles and working methods governing\nproposals for future EU substantive criminal law provisions.</span>\nThey invite the Commission and the Council to establish an\n<b>inter-institutional working group</b> in which these\ninstitutions and Parliament can draw up such an agreement and\ndiscuss general matters. This inter-institutional working group\nshould help to define the proper scope and application of\n<b>criminal-law sanctions at EU level</b>, as well as examining\nexisting legislation with a view to reducing the fragmentation and\nconflicts of jurisdiction characterising the current approach.</p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">Lastly, the report emphasises the importance of\nestablishing an information service for Parliament that can support\nthe individual Members in their daily work, thus ensuring the\nquality of Parliament&#146;s work as a co-legislator.</span></p>\n</div>\n"

          "<div id=\"summary\">\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The Committee on Civil Liberties, Justice and Home\nAffairs adopted the own-initiative report by Cornelis de JONG\n(GUE/NGL, NL) on an EU approach on criminal law.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The report</span> <span lang=\"EN-GB\">welcomes the\nrecognition by the Commission in its recent <a href=\"http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=COM:2011:0573:FIN:EN:PDF\">Communication\non an EU criminal law policy</a> that the first step in criminal\nlaw legislation should always be to decide <b>whether to adopt\nsubstantive criminal law measures at all</b>.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">In this spirit, Members stress that proposals for EU\nsubstantive criminal law provisions must fully <b>respect the\nprinciples of subsidiarity and proportionality</b>. In their\nview,</span> <span lang=\"EN-GB\">the necessity of new substantive\ncriminal law provisions must be demonstrated by the necessary\nfactual evidence making it clear that:</span></p>\n<ul style=\"margin-top:0cm\" type=\"disc\">\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">the criminal provisions focus on conduct causing\nsignificant pecuniary or non-pecuniary damage to society,\nindividuals or a group of individuals;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">there are no other, less intrusive measures available\nfor addressing such conduct;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">the crime involved is of a particularly serious nature\nwith a cross-border dimension or has a direct negative impact on\nthe effective implementation of a Union policy in an area which has\nbeen subject to harmonisation measures;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">there is a need to combat the criminal offence\nconcerned on a common basis; and</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">the severity of the proposed sanctions is not\ndisproportionate to the criminal offence.</span></li>\n</ul>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The report stresses that harmonisation measures should\nbe proposed primarily with a view to <b>supporting the application\nof the principle of mutual recognition</b> in practice, rather than\nmerely expanding the scope of harmonised EU criminal law.</span>\nMembers also insist on the need to establish <b>uniform minimum\nstandards of protection at the highest possible level for suspects\nand defendants</b> in criminal proceedings in order to strengthen\nmutual trust. In this regard, they recall that criminal law must\n<b>fully respect the fundamental rights</b> of suspected, accused\nor convicted persons.</p>\n<p style=\"text-align:justify\" class=\"MsoNormal\">The Commission is\nencouraged to:</p>\n<ul style=\"margin-top:0cm\" type=\"disc\">\n<li style=\"text-align:justify\" class=\"MsoNormal\">put forward\nmeasures that <b>facilitate more consistent and coherent\nenforcement</b> at national level of existing provisions of\nsubstantive EU criminal law, without prejudice to the principles of\nnecessity and subsidiarity;</li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">include in its impact assessments the <b>necessity and\nproportionality test</b>;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\">draw on the\n<b>best practices</b> of those Member States with a high level of\nprocedural rights guarantees;</li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">include an evaluation based on its <b>fundamental\nrights checklist</b>; and</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\">introduce a test\nspecifying how its proposals reflect the <b>general principles</b>\ngoverning criminal law (e.g. principles of individual guilt; legal\ncertainty, non-retroactivity and the presumption of\ninnocence).</li>\n</ul>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The report underlines the need for a <b>more coherent\nand high-quality EU approach</b> to criminal law and deplores the\nfragmented approach followed so far.</span> With this in mind, it\ncalls for a clear, <b>coordinating authority</b> within the\nCommission for all proposals which contain criminal law\nprovisions.</p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">Members call for an <b>inter-institutional\nagreement</b> on the principles and working methods governing\nproposals for future EU substantive criminal law provisions.</span>\nThey invite the Commission and the Council to establish an\n<b>inter-institutional working group</b> in which these\ninstitutions and Parliament can draw up such an agreement and\ndiscuss general matters. This inter-institutional working group\nshould help to define the proper scope and application of\n<b>criminal-law sanctions at EU level</b>, as well as examining\nexisting legislation with a view to reducing the fragmentation and\nconflicts of jurisdiction characterising the current approach.</p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">Lastly, the report emphasises the importance of\nestablishing an information service for Parliament that can support\nthe individual Members in their daily work, thus ensuring the\nquality of Parliament&#146;s work as a co-legislator.</span></p>\n</div>\n"

              "<div id=\"summary\">\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The Committee on Civil Liberties, Justice and Home\nAffairs adopted the own-initiative report by Cornelis de JONG\n(GUE/NGL, NL) on an EU approach on criminal law.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The report</span> <span lang=\"EN-GB\">welcomes the\nrecognition by the Commission in its recent <a href=\"http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=COM:2011:0573:FIN:EN:PDF\">Communication\non an EU criminal law policy</a> that the first step in criminal\nlaw legislation should always be to decide <b>whether to adopt\nsubstantive criminal law measures at all</b>.</span></p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">In this spirit, Members stress that proposals for EU\nsubstantive criminal law provisions must fully <b>respect the\nprinciples of subsidiarity and proportionality</b>. In their\nview,</span> <span lang=\"EN-GB\">the necessity of new substantive\ncriminal law provisions must be demonstrated by the necessary\nfactual evidence making it clear that:</span></p>\n<ul style=\"margin-top:0cm\" type=\"disc\">\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">the criminal provisions focus on conduct causing\nsignificant pecuniary or non-pecuniary damage to society,\nindividuals or a group of individuals;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">there are no other, less intrusive measures available\nfor addressing such conduct;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">the crime involved is of a particularly serious nature\nwith a cross-border dimension or has a direct negative impact on\nthe effective implementation of a Union policy in an area which has\nbeen subject to harmonisation measures;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">there is a need to combat the criminal offence\nconcerned on a common basis; and</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">the severity of the proposed sanctions is not\ndisproportionate to the criminal offence.</span></li>\n</ul>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The report stresses that harmonisation measures should\nbe proposed primarily with a view to <b>supporting the application\nof the principle of mutual recognition</b> in practice, rather than\nmerely expanding the scope of harmonised EU criminal law.</span>\nMembers also insist on the need to establish <b>uniform minimum\nstandards of protection at the highest possible level for suspects\nand defendants</b> in criminal proceedings in order to strengthen\nmutual trust. In this regard, they recall that criminal law must\n<b>fully respect the fundamental rights</b> of suspected, accused\nor convicted persons.</p>\n<p style=\"text-align:justify\" class=\"MsoNormal\">The Commission is\nencouraged to:</p>\n<ul style=\"margin-top:0cm\" type=\"disc\">\n<li style=\"text-align:justify\" class=\"MsoNormal\">put forward\nmeasures that <b>facilitate more consistent and coherent\nenforcement</b> at national level of existing provisions of\nsubstantive EU criminal law, without prejudice to the principles of\nnecessity and subsidiarity;</li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">include in its impact assessments the <b>necessity and\nproportionality test</b>;</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\">draw on the\n<b>best practices</b> of those Member States with a high level of\nprocedural rights guarantees;</li>\n<li style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">include an evaluation based on its <b>fundamental\nrights checklist</b>; and</span></li>\n<li style=\"text-align:justify\" class=\"MsoNormal\">introduce a test\nspecifying how its proposals reflect the <b>general principles</b>\ngoverning criminal law (e.g. principles of individual guilt; legal\ncertainty, non-retroactivity and the presumption of\ninnocence).</li>\n</ul>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">The report underlines the need for a <b>more coherent\nand high-quality EU approach</b> to criminal law and deplores the\nfragmented approach followed so far.</span> With this in mind, it\ncalls for a clear, <b>coordinating authority</b> within the\nCommission for all proposals which contain criminal law\nprovisions.</p>\n<p style=\"text-align:justify\" class=\"MsoNormal\"><span lang=\"EN-GB\">Members call for an <b>inter-institutional\nagreement</b> on the principles and working methods governing\nproposals for future EU substantive criminal law provisions.</span>\nThey invite the Commission and the Council to establish an\n<b>inter-institutional working group</b> in which these\ninstitutions and Parliament can draw up such an agreement and\ndiscuss general matters.
